The rules of the game.

Welcome to cuentoconlaIA.com (the “Service”), an online service that generates personalised AI-illustrated children’s books, operated by Nexo Apex S.L. (Spanish CIF B55467146), Edificio Camí Reial, c/ Camí Reial 13-17, 3rd floor, 43700 El Vendrell, Tarragona, Spain.
1. Scope & acceptance
These terms govern your access to and use of the Service. By placing an order you accept these terms in full. If you disagree with any part, please do not use the Service.
You must be over 18 to use the Service. It is intended for adults (parents or legal guardians) creating books for their children or authorised relatives.
2. Price & payment
Two plans are available:
- No preview — €3.99 (VAT included). Direct generation of the complete 20-page book.
- With preview — €5.99 (VAT included). You first receive a 5-page preview; on confirmation, we generate the remaining 15 pages at no extra cost.
Payments are processed by Stripe. We never store your card data. Receipts are emailed to the address you provided at checkout; formal invoices can be requested at hola@cuentoconlaIA.com.
3. Express waiver of right of withdrawal
Important. The book is personalised digital content that is generated and delivered immediately after payment. Pursuant to Article 16(m) of EU Directive 2011/83/EU (transposed into Spanish law by Article 103.m of Royal Legislative Decree 1/2007), the 14-day right of withdrawal does not apply.
Before paying, you confirm by ticking the box:
“I agree that generation begins immediately and I waive my right of withdrawal (Art. 16(m) of EU Directive 2011/83/EU).”
Notwithstanding the above, if generation fails for reasons attributable to us (e.g. a technical issue in our infrastructure), we will issue a full refund automatically or, if you prefer, regenerate your book at no cost.
4. AI generation
The book is generated by third-party AI models (currently OpenAI; optionally Anthropic for safety verification). This implies:
- Images and text are creative approximations. There may be inaccuracies or visual/textual anomalies.
- Generated faces may not exactly match the real people you uploaded. Some stylistic variation is expected.
- If an image cannot be processed or is blocked by our moderation system, we will email you so you can try again or request a refund.
- Per Article 50 of EU Regulation 2024/1689 (EU AI Act), all generated content is labelled as AI-produced.
laIA can make mistakes. The creations are approximate and may contain errors. Use them with your own judgement.
5. Intellectual property
5.1 Your content
You retain all rights to the photos you upload and the text you provide. By uploading, you grant us a non-exclusive, royalty-free, worldwide, time-limited licence to process them solely to generate and deliver your book. The licence terminates automatically when the photos are deleted (at 30 days or sooner if you request).
5.2 Generated book
We grant you a non-exclusive, worldwide, perpetual licence to use, share, print and reproduce the generated book for personal, family and non-commercial use. Any commercial exploitation (sale, mass distribution, editorial use) requires our prior written consent.
5.3 Brand & design
The name “cuentoconlaIA.com”, the laIA mascot, the logos and the site design are ours and are protected by intellectual property and trademark law. They may not be used without authorisation.
6. Acceptable use
By using the Service you agree not to upload or request generation of:
- Sexual, sexualised or suggestive content, especially involving minors.
- Violent, gore or violence-glorifying content.
- Photos of minors who are not your children or relatives and for whom you do not have express parental/guardian authorisation.
- Characters protected by third-party copyright (Disney, Pixar, etc.). Our system automatically blocks these requests.
- Content that incites hate, discrimination or terrorism.
- Any fraudulent, mass-automated or Service-disrupting use.
Breach permits immediate cancellation of the order without refund and, where appropriate, notification to competent authorities (LSSI-CE Art. 16).
7. Liability cap
To the maximum extent permitted by EU consumer law, our liability for damages arising from your use of the Service is capped at the amount actually paid for the affected order (€3.99 or €5.99).
This cap does not apply to wilful misconduct, gross negligence, harm to health, or other liabilities that the law declares non-waivable in favour of consumers.
The Service is provided “as is”, without implied warranties beyond those required by applicable law.
8. Changes
We may modify these terms to reflect legal or functional changes. Updates are published on this page and take effect 30 days after publication. Orders in flight are always governed by the terms in force at the time of purchase.
9. Governing law & jurisdiction
These terms are governed by Spanish law. For any dispute, the parties submit to the courts of Tarragona (Nexo Apex S.L.’s registered seat), without prejudice to the consumer’s right to bring claims before the courts of their own domicile.
